Bald Eagle and Migratory Bird Evaluation and Permitting

Projects involving existing infrastructure may require evaluation of potential impacts to nesting birds protected under the Migratory Bird Treaty Act (MBTA) and the Bald and Golden Eagle Protection Act (BGEPA). Where eagle or other migratory bird concerns are present, ECA conducts initial desktop reviews and on-site activity assessments to determine the presence and activity status of nests on or near project structures or work areas, providing critical information to guide project planning and compliance.

Based on observed nest conditions and species-specific protections, ECA develops practical recommendations to help clients avoid impacts, including guidance on appropriate work timing, buffer considerations, and avoidance measures. When active nests are identified, our team works with clients to adjust project approaches in a manner that maintains compliance while minimizing schedule disruptions. Where necessary, ECA provides on-site monitoring services to document work near sensitive bird resources and to advise clients and their contractors on measures to minimize impacts to these resources in accordance with applicable laws, regulations, and guidance.

ECA also provides pre-construction nest clearance surveys to verify the absence of active nesting within proposed work areas, helping clients proactively manage risk prior to mobilization. Where regulated bird resources are identified and cannot be avoided, ECA coordinates directly with the U.S. Fish and Wildlife Service (USFWS) and other applicable agencies to navigate regulatory requirements and secure necessary permits for nest removal or work near sensitive resources.

ECA’s experienced biologists bring extensive knowledge of avian regulations and field conditions, along with strong relationships with regulatory agencies. Our practical, responsive approach helps clients efficiently address eagle and other migratory bird constraints while maintaining compliance and keeping projects on track.
